Non-Coal Surface Mining Permit

A permit is required for mineral extraction operations that will result in a land disturbance of one (1) acre or more. Minerals are defined as any substance of commercial value found in natural deposits on or in the earth. This includes, but is not limited to, clay, gravel, metallic ores, sand, soil, and stone. Coal is specifically excluded from this definition. Permits must be renewed every five (5) years and are subject to unlimited renewals.

A valid permit is required for any operator undertaking the extraction of oil or natural gas from the earth. This authorization specifically covers the production of oil or gas via a drilled well. It is important to note that, due to Maryland's enacted moratorium on hydraulic fracturing (hydrofracking), the State has not received any applications for new wells since the moratorium took effect.
