A permit is required for mineral extraction operations that will result in a land disturbance of one (1) acre or more. Minerals are defined as any substance of commercial value found in natural deposits on or in the earth. This includes, but is not limited to, clay, gravel, metallic ores, sand, soil, and stone. Coal is specifically excluded from this definition. Permits must be renewed every five (5) years and are subject to unlimited renewals.

It is important to note that, due to Maryland's enacted moratorium on hydraulic fracturing (hydrofracking), the State has not received any applications for new wells since the moratorium took effect.
